League City woman alleges sexual assault by nurse at Clear Lake hospital
A League City woman is suing a Clear Lake hospital after she was allegedly sexually assaulted by a nurse.
Kristy Megale filed a lawsuit April 21 in Harris County Circuit Court against Clear Lake Regional Medical Center and the unidentified male employee.
According to the complaint, Megale went to the Clear Lake emergency room in July 2010. Megale, who was seven weeks pregnant at the time, says she was suffering from vaginal bleeding, cramping and worried she might be having a miscarriage.
Shortly after being admitted to a room, Megale says a young man came in and identified himself as her nurse. He allegedly instructed Megale to remove her clothing from the waist up while he watched. Megale claims the nurse then helped her into a hospital gown.
Megale claims the man then had her remove the rest of her clothes and position herself on the exam table with her feet in the stirrups. She says the nurse sat on a stool in close proximity and in full view of her naked body. She says he held her lower leg with his hand while she adjusted herself on the table. Megale says a female nurse entered the room and asked why the bed was positioned the way it was.
Megale says the male nurse left the room during the pelvic exam. Megale claims the doctor never once sat on the stool during the exam nor were her feet held into the stirrups. Three days later, Megale says she had a miscarriage.
Megale says she was sexually violated and accuses the hospital of negligence. She says the incident caused her emotional distress, a situation she says contributed to her losing her baby. Megale is also suing for assault and battery after the unidentified nurse allegedly put her in compromising positions, and in some instances, held her leg in a stirrup.
Megale is asking for an undetermined amount of money in damages plus court fees.
