Clear Lake resident sues after hailstorm
An insurer is being sued over claims that it refused to cover home repairs in Clear Lake.
Cho Ha filed a lawsuit on April 6 in the Harris County District Court against Texas Farmers Insurance Co., alleging violations of the Texas Insurance Code, fraud, breach of contract, and breach of duty of good faith and fair dealing.
Ha says that in March 2009, a hailstorm damaged his roof and caused wind and water damage to his home, located at Diamond Brook in Clear Lake. According to the brief, the defendant, Ha’s insurer, wrongfully refuses to cover the cost of repairs to his property as required by their contract.
Ha is seeking actual, exemplary, treble and punitive damages, as well as attorney’s fees and court costs. He is being represented in the case by Houston attorney Daniel Barton.
