Clear Lake resident sued over back patio

A homeowners association is suing a Clear Lake resident over step pavers, brick pavers and flowerbed pebbles.

Park Shadows Home Owners Association filed a lawsuit on Feb. 2 in the Harris County District Court against Clear Lake resident Dan Ung, alleging breach of contract.

The Association says that Ung has been in violation of his property’s deed restrictions by failing to remove an unauthorized deck in his back patio, failing to remove step pavers near his back patio, failing to remove brick pavers on the right side of his driveway and failing to remove pebbles in an island flowerbed.

According to the brief, these deed violations are causing irreparable damage to the Association.

The Association is seeking injunctive relief and civil damages, charging $200 for each day he remains in violation of the deed restrictions, attorney’s fees and court costs. It is being represented in the case by Houston attorney Luke Tollett.
