League City man sentenced in death of his infant son
GALVESTON — A League City man was sentenced to life imprisonment today after his conviction in the death of his 6-week-old son.
Galveston County District Judge Lonnie Cox sentenced Jose Isaias Herrera, 20, a day after a jury convicted him of first-degree injury to a child while knowingly causing serious bodily injury, said Donna Goode, first assistant district attorney.
Prosecutor Kayla Allen convinced the jury to rule that Herrera used a deadly weapon, defined as his hand or an unknown weapon, to kill Jose Herrera Jr. Oct. 27, 2008. The special finding means that Herrera will not be eligible for parole until serving half his sentence, or 30 years, Goode said.
The child was unresponsive when League City police and paramedics arrived at Herrera's home. The infant died at a hospital.
Prosecutors are deciding how to proceed against the child's mother, Jessica Marie Trevino, 20, who is also charged with her son's death.
