KHOU: Prosecutors drop murder charge against man in 2007 infant death case

Prosecutors have dropped a murder charge against a man in connection with the 2007 death of his 6-week-old son in League City, choosing to indict him with injuring a child instead, according to Houston CBS affiliate KHOU:

Jose Isaias Herrera, 19, remained jailed without bond on an immigration hold, stemming from an Oct. 27, 2007, incident at his League City home, where the infant Jose Herrera Jr. was found dead.

Judge Lonnie Cox, of Galveston’s 56th District Court, delayed the capital murder trial, originally set to begin last month, until Dec. 6 after a state child protective services agency failed to produce all documents in the case.

The state then indicted Herrera on an injury to a child charge, Herrera’s attorney, Jeth Jones, said.
